The following documents outline the terms of service for using Givto. You should read through these terms before using Givto.

Terms and conditions

The terms on which you may make use of our website

Givto (the “Website”) is operated by the Better Giving Partnership. Our registered office is at 1 Great Close, Cawood, North Yorkshire. Our charity registration number is 1168976.

These are the general terms and conditions which govern your use of the Website. Please read these terms and conditions carefully. If you do not wish to be bound by these terms and conditions, you should not continue to use or access the Website.

These terms and conditions may change or be updated from time to time. It remains your responsibility to access and check these terms and conditions whenever you access the Website. The latest version of these terms and conditions will govern any future usage by you of the Website.

About the featured charities

The charities on our website that you can give to

The Website enables you as a registered user to give to any of the three charities presented to you each month.

Every charity featured has a contractual agreement with Better Giving Partnership. This sets out that Better Giving Partnership will collect donations and reclaim Gift Aid under the UK Government’s Gift Aid scheme, and pass these on to users’ chosen charities each month.

Charities must be registered with the Charity Commission for England and Wales to be featured on the Website. Charities are accepted as members at the discretion of Better Giving Partnership.

Charities can have similar names: it is your responsibility to check that you are giving to the organisation you intended. Better Giving Partnership is not responsible for the activities of any charity featured on the Website.

The Website contains links to the websites and social media channels of member charities. Inclusion of a link to another website does not imply endorsement of its content or opinions. Your relationship and any transactions with other charities through their websites or otherwise are your own responsibility.

Donations

How we send your donations to your chosen charity

Registered users of the Website make monthly donations to the Better Giving Partnership by Direct Debit and indicate which charity they would like their donation and Gift Aid (where this applies) to go to each month. We hold these funds and pay the user’s chosen charity every month in accordance with our agreement with them.

Better Giving Partnership trustees have absolute discretion over how all donations it receives are spent. Only in exceptional circumstances would funds not be paid to the charity indicated by a user, for example where a charity ceases trading. If this occurs, the user will be notified by Better Giving Partnership and asked to choose another charity.

We only accept payments through the Website in pounds sterling via our payment service provider GoCardless Ltd.

Direct Debits collected by GoCardless Ltd are covered by the Direct Debit Guarantee. Information about your Direct Debit and the guarantee will be emailed to you by GoCardless Ltd when you register to use the Website. Please refer to the GoCardless Ltd Terms of Service.

Refunds

If an error is made in the payment of your Direct Debit by GoCardless Ltd or your bank or building society, you are entitled to a full and immediate refund of the amount paid from your bank or building society. In these circumstances, please contact your bank or building society initially.

Refunds will not be provided for any other reason.

You can cancel a Direct Debit at any time by simply contacting us at help@givto.org or by contacting your bank or building society.

Use of your donation

Better Giving Partnership is not responsible for any dissatisfaction you may have with the way a charity uses the donation you make through the Website.

Please note that the chosen charity reserves the right to use your donation for its general purposes. We cannot guarantee that funds will be earmarked for a particular appeal, unless specifically stated by the charity itself in its’ description. If you want a donation to be used for a specific purpose or for a particular appeal, please contact the chosen charity and make your donation to them directly.

After donations are made and paid to your chosen charity, all further dealings are solely between you and the chosen charity.

Fees

The fees we charge to fund the Website

As a registered charity, Better Giving Partnership trustees are committed to keeping fees as low as possible. Fees are only imposed to cover costs incurred to run the Website.

Better Giving Partnership imposes a fee on donations and on Gift Aid claims of 3%.

Our payment service provider GoCardless Ltd imposes a transaction fee on Direct Debits of 1% + 20p + VAT.

Unauthorised use

When a donation is made via the Website it can only be cancelled if caused by unauthorised use of your account.

If you become aware of fraudulent use of your account, you must notify us and your bank or building society, in accordance with its reporting rules.

We will never contact you and ask you to provide your payment details.

Protecting your password

You are responsible for maintaining the confidentiality of the password you choose to protect your account when registering with the Website, and prevent others from gaining access to your personal information.

If you become aware of any unauthorised use of your password, we recommend that you change your password immediately. You can do this by clicking on ‘Forgotten your password’ on the log in page of the Website.

Gift Aid information

When you register to use the Website and confirm that you are a UK taxpayer (in accordance with the requirements of the Gift Aid scheme as they apply from time to time), Better Giving Partnership reclaims Gift Aid on your donations under the Gift Aid scheme and pays this to your chosen charity, minus any fee.

Better Giving Partnership is not an accounting, taxation, or financial advisor and you should not rely on information given on the Website to determine the accounting, tax or financial consequences of making a donation to charity. We recommend that you seek your own advice about any accounting, taxation or financial consequences that may affect you.

Privacy

Our Privacy Policy forms part of these terms and conditions. By agreeing to these terms and conditions you also give your consent to the way we may handle your personal information under that policy.

User conduct

You must at all times use the Website and its associated services in a responsible and legal manner. In particular, but not exclusively:

  1. you must not interfere with, or disrupt, the Website, related services or networks connected to the service and introduce any computer virus (including any variant or similar malicious code or instructions) to the Website, related systems or networks.
  2. you must not attempt to modify, adapt, translate, sell, reverse engineer, decompile or disassemble any portion of the Website or related services.
  3. you must not attempt to bypass the network firewall.
  4. you must not use any part of the site which you are not authorised to use or devise ways to circumvent security in order to access part of the site which you are not authorised to access (including scanning networks with intent to breach and/or evaluate security, whether or not the intrusion results in access).
  5. you must not use or attempt to use the site for any unlawful, criminal, or negligent purposes (including password cracking, social engineering, denial-of-service attacks, harmful and malicious destruction of data, and intentional invasion of privacy).

Trademarks

The name ‘Givto’ and the Givto logo are registered trademarks and may not be used in connection with any product or service that does not belong to Better Giving Partnership, nor in any manner that is likely to cause confusion, or in any way that may disparage or discredit Givto or Better Giving Partnership.

Other trademarks, service marks or logos that appear on the Website, in particular (but not exclusively) those of member charities, are the property of their respective owners and are likely to be registered trademarks and subject to restrictions as to their use. They must not be used without the express permission of the trademark owner.

Copyright

All content on the Website is owned by Better Giving Partnership or our member charities and is protected by the applicable intellectual property and proprietary rights and laws. No reproduction or copying of content on the Website is permitted without the express prior permission of Better Giving Partnership, and, where applicable, the copyright holder.

Changes to the service

Better Giving Partnership will make every effort to ensure that the Website and other services are available continuously, but reserves the right to modify, suspend or discontinue all or any part at any time with or without notice. Unless specifically exempted, any new features, services or software applications introduced shall be subject to these terms and conditions.

Failure to comply with the terms and conditions

In the event that you commit a breach of these terms and conditions, Better Giving Partnership reserves the right at its sole discretion to immediately and without notice suspend or permanently deny your access to all or part of the Website and services.

Termination

You may discontinue use of the Website and services at any time. These terms and conditions will continue to apply to past use by you.

Disclaimer and limitation of liability

Better Giving Partnership does not, and nothing in these terms and conditions shall act to, exclude or limit Better Giving Partnership’s liability for death or personal injury resulting from its negligence, fraud or any other liability which may not by applicable law be excluded or limited.

You agree that your use of the Website is on an “as is” and “as available” basis and that your use of the Website is at your sole risk.

Better Giving Partnership does not guarantee continuous uninterrupted or secure access to our services and operation of the Website may be interfered with by numerous factors outside of our control. On that basis, except as expressly set out in these terms and conditions, Better Giving Partnership does not provide conditions, warranties, or other terms in relation to the Website, to the extent permissible by law.

Subject to exceptions listed above, in no event shall Better Giving Partnership be liable (whether for breach of contract, negligence or for any other reason) for any loss or damage which you may claim to have suffered by reason of your accessing and use of the Website, including (but not limited to) loss of profits, exemplary or special damages, loss of sales, loss of revenue, loss of goodwill, loss of any software or data, loss of bargain, loss of opportunity, loss of use of computer equipment, loss of or waste of management or other staff time, or for any indirect, consequential or special loss, however arising.

Better Giving Partnership may change the format and content of the Website from time to time. You should refresh your browser each time you visit the Website to ensure that you access the most up to date version of the Website, including the latest version of these terms and conditions.

Governing law

These terms and conditions are governed by English law and are subject to the exclusive jurisdiction of the English courts.

Third party rights

A person who is not a party to these terms and conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these terms and conditions.
